Permit to Excavate in Street Right-of-Way

A Right-of-Way Permit must be obtained prior to any excavation made in a street, alley, or public area within the City of Eau Claire; this is a requirement of Wisconsin Statutes and City Code of Ordinances Section 13.10. A form must be completed to obtain this permit.

 

Right-of-Way (ROW) Permit Process

Complete the ROW Permit Form

Download and email the form to jodi.nuenke@eauclairewi.gov or pick up the form in the Engineering Department located at 203 S. Farwell Street.

  • R-O-W Permit Form (pdf) *Do not open in browser*
    • 'Right Click' link and select 'Save Link As' (Chrome) or 'Save Target As' (IE) to download the form.
    • When done filling in form, click 'Submit Form' and Select 'Internet Email' to save form.
    • Attach form to an email message.

Submit the ROW Application Fee

  • The ROW Permit Application Fee is $37.00.
    • This charge is for any person working or excavating within the right-of-way of a street, alley, or public place within the City of Eau Claire.
      • Contractors performing excavation work while under City contract are not required to obtain a permit for such work unless a permit is specifically required by the City.
    • The fee must be paid at time of application or permit will not be processed or issued. The exception to this is if monthly billing has been approved.

Monthly Billing

Monthly billing may be requested and approved for businesses that submit a substantial number of permit requests during the year. The City then prepares a billing each month and lists the issued permit numbers for these approved businesses. If monthly billing is approved, the permit application fee doesn't have to accompany the permit request before being processed and issued.
